Name & Gender Changes in Upstate New York

WELCOME!

Thanks for considering me as someone who can help you with your legal name and gender marker change needs! I have over 8 years of experience helping hundreds of transgender, non-binary, gender expansive, Two-Spirit, and cisgender people with this process, and I'd be thrilled to help you with it, too. My goal is to make this as smooth, painless, and quick as possible so you can get what you need to move forward with your life as your most authentic self!
 

WHO I WORK WITH.

At this time, I only work with clients who reside in counties in Upstate New York. Courts in NYC and Long Island have particular requirements (often including in-person appearances) that I don't have experience with and can't show up for at this time. I'm happy to offer referrals to attorneys who offer name change help in NYC and Long Island if needed.

 

COSTS.

I charge a flat rate of $1,250 for adult or minor name changes. This covers my time (an average of 3 hours at $350/hour), $210 for the filing fee with the county clerk's office, and credit card processing fees. You can pay the entire cost upfront or in a payment plan of $312.50/month for 4 months, whichever is most convenient.

If you cannot afford this fee, I'm happy to refer you to local non-profit legal services organizations in your area that might be able to help you for free, or to the court's DIY resources if you'd like to try going through the process without an attorney.
 

PROCESS.

We'll start with a brief 30 minute consultation so I can explain the process to you, ask clarifying questions about your goals and specific situation, and figure out what other information we need to gather in order to move forward.

 

This is a remote legal service, so most of our work will be done electronically over email or by mail. Once we have everything in order, I'll draft your petition and send it to you to execute (sign) in front a local notary and return to me.

Once I get it back, I will prepare and file all the documents with the county clerk and supreme court near you. Together, we'll get you the golden ticket of a court order to move forward with your life with your authentic name (and gender, if desired).

At the end of the process, I'll send you all the forms and information you need to update all of your identity documents and records to reflect your new name and/or gender marker.​

More About Me

My name is Emile (e-meel), but I go by Milo and use he/they pronouns. I am a white queer transgender person and long-time LGBTQ+ rights advocate. Since 2014, I've helped hundred of people legally change their name and gender markers in Washington, DC, Maryland, Virginia, and across Upstate New York. I'm happy to help you through this process as well!

 

Since 2018, I've run a solo virtual civil rights practice out of my home office in Upstate New York, and lead Just Roots Consulting, a certified LGBTQ-owned social enterprise that helps organizations become industry leaders in workplace equity.

Previously, I led the LGBT Rights Project at Empire Justice Center in Rochester, NY, and served as an Equal Justice Works AmeriCorps Legal Fellow at Whitman-Walker Health in Washington, DC. I've provided direct legal services to hundreds of low-income LGBTQ+ people, focusing especially on transgender name changes and LGBTQ-based discrimination in employment, education, healthcare, and places of public accommodation. I've trained thousands of attorneys and judges to respectfully and competently serve LGBTQ+ people, and have equipped LGBTQ+ communities nationwide to exercise their legal rights under state and federal law. I've worked closely with state administrative agencies, legislators, and policymakers to ensure that the law works for all LGBTQ+ New Yorkers. 

I currently serve by appointment on the Richard C. Failla LGBTQ Judicial Commission of the New York State Courts. I earned a Bachelors in Philosophy from the Ohio State University, and a Juris Doctor from the City University of New York (CUNY) School of Law.
